The Hulk Hogan Case — Everything You Need to Know

Terry “Hulk Hogan” Bollea was awarded $115 million for emotional distress ($60 million) and economic damages ($55 million) in his case against Gawker Media, and he stands to gain even more when the jury decides on punitive damages. Punitive damages can total three times the award, which nets out at $345 million. Though unlikely, punitive means “punishment,” and if the jury wants to send a message, that’s where they’ll do it. According to the Los Angeles Times, Judge Pamela A.M. Campbell of the Sixth Judicial Circuit Court in Pinellas County advised the jury that the damages should not devastate the defendants, which include founder Nick Denton and Albert J. Daulerio, who was editor-in-chief of Gawker.com at the time the sex video was published. Denton is worth $121 million, and Gawker made nearly $50 million last year alone. As for Albert J. Daulerio, he’s insolvent. One thing is clear; however, and it’s that Daulerio deserves punishment.

While on trial, Daulerio was asked about whether he could imagine a situation in which a celebrity sex tape would not be “newsworthy,” and he said “if they were a child.” He then said that the only banned age would be “four.” He later back off his testimony insisting it was a joke, though the damage was likely done. It was also revealed during trial that he ignored desperate pleas from a college student to remove a video of her having drunken sex on the floor of a bathroom stall, claiming again that it was “newsworthy.” When asked whether he investigated the tape to determine if the sex was consensual, he admitted that he did not. In fact, he responded to the victim’s email plea by saying “Blah, blah, blah” followed by “advice” to “keep [her] head up.” In an interview with GQ Magazine, he admitted that the video in question might have in fact been a rape.

Because so many people misunderstand what “Freedom of Speech” means according to the First Amendment, this case provides the perfect opportunity to explain it. We’ve all heard “you can’t yell fire in a crowded theater” as a limitation on free speech, but what exactly does that mean, and how does it apply to the Hulk case? For starters, Hulk is suing for Invasion of Privacy, and Gawker’s entire defense revolves around the First Amendment. Our right to privacy means that one can not publicly disclose private information if it would offend a reasonable person, and if that information is not “NEWSWORTHY.” To sum this up in a nutshell in relation to Hogan, “the jury balanced privacy and press rights, and privacy won.” Because courts have traditionally upheld press rights, this case is monumental, and it will certainly send a message. As for Hogan, he’s aware, tweeting “Told ya I was gonna slam another giant” immediately after the verdict.

As a lawyer and a blogger that has long vowed to never post paparazzi pictures or invade the privacy of celebrities, this is especially interesting from a legal standpoint. Having said that, I’m getting more questions about the backstory of this sex tape than the lawsuit, so in an effort to satisfy that curiosity, here goes.

Hogan and Bubba “the Love Sponge” Clem were longtime friends, and the Sirius radio “shock jock” claimed to have helped Hogan heal from his tempestuous divorce with then-wife Linda. The pain of his divorce also came on the heels of his son’s arrest and some alleged financial issues. Needless to say, Hogan was not in the best place, and what does a good friend do when you’re grieving the loss of your family as you knew it? Well . . . he offers his wife, of course. Bubba told Hogan to have sex with his wife Heather, though their stories vary as to who initiated this idea. Bubba did not watch the act itself but seemed completely fine with sharing his wife. According to Hogan, he had no idea he was being filmed. When asked by Howard Stern what kind of marital arrangement they had, Bubba would not elaborate. Stern asked if Bubba suffered from some type of erectile disfunction, but Bubba remained coy. Clem and his wife later divorced. The sex tape in question was allegedly stolen by a former, disgruntled employee of Bubba’s, though he was not prosecuted for the theft. Gawker got wind of the tape and posted a minute long snippet. That was enough, and Hogan sued. The rest is history. Bubba and Hogan are no longer friends.

There are a lot of lessons to be learned from this case. First, if you are a blood-sucking maggot, you will get your due, and it’s nice to know a jury of our peers has a conscience. Second, though friends might let friends fu-k their wife, they certainly don’t tape it. Third, if your wife wants to f-ck other dudes and you’re not watching, she’s either selfish or your sex drive needs a serious evaluation. And lastly, don’t leave your secret sex tapes in your office for your employees to steal. If you do, label them “easy diet tricks.”

Erin Andrews Awarded $55 Million — You Go Girl!

The next time you see naked images of A-listers are on the internet, think of Erin Andrews, who was just awarded $55 million in damages for a secret 2008 recording of the naked Sportscaster that was filmed at the Nashville Marriott by a peeping tom. And if that first sentence sparks your curiosity enough to actually google the video, think of Marriott Executive Neal Peskind, and how the invasive internet ironically worked in Andrews’ favor during trial, when a bartender allegedly witnessed the franchise owner of the Vanderbilt Marriott Hotel that Erin sued actually watching the video with pals at dinner while complaining about the cost of the trial. Perhaps a $55 million judgment will make him and everyone else think a little more seriously about the implications of such an offense. Andrews alleged that the Marriott revealed her room number to her stalker, and then booked him in the room beside her upon his request, which allowed for him to film her naked in a four minute video of the star undressing. It has since been viewed nearly 17 million times. Her stalker allegedly followed her to three different cities, and he had at least 17 other victims. It’s also worth noting that her stalker is responsible for 51% of the damages (which she will likely never receive), while the Nashville Marriott and West End Hotel Partners, the company that owns the hotel, are responsible for the remaining 49%.

It goes without saying that the Marriott should have settled. Andrews is proven to be extremely likable, and watching her tears on the stand is sure to generate serious dollars. On top of that, this is a serious security breach that could have been prevented, and although the awarded judgment seems excessive, it will send a message that could not be achieved any other way. Without her tearful testimony, there’s no face to these crimes, and this might heighten security restrictions at hotels. We are all safer today because of Erin Andrews.

Leonardo DiCaprio Talks Global Warming But Flies Private Jets?!

dicaprioLeonardo DiCaprio has used this entire awards season to raise awareness about Global Warming, and his Oscar speech was no different. In fact, DiCaprio told the press that winning the Oscar was especially important because he could use a very wide audience to educate the public on the perils of our warming planet. But there’s a very significant contradiction looming over the A-listers speech, and it involves his questionable methods of travel. While he might encourage others to lighten their carbon load, ‘The Revenant’ star is doing no such thing. His preference for private jets was exposed in the Sony hacks, which indicated that he used the planet-warming travel choice six times in just six weeks. If you’re wondering what this means, the Essential Action and the Institute for Policy Studies indicate that “an hour of flying a private jet burns as much fuel as an entire year of driving a car.” Another study suggests that “flying turns out to be on average 50 times worse than driving in terms of a five-year warming impact.” DiCaprio’s Prius can’t possibly plug that leak. Global warming certainly a serious issue, and its great that shined a light on it. But he’s also a hypocrite, as are most people, that hypocrisy might warm our planet.

On the heels of Beyonce’s kick-ass ‘Formation’ video, Lamar graciously performed at the Grammy’s, proving that even though that awards show doesn’t deserve him, he will give his consistent 100% amidst the night’s many non-contenders. Why Taylor Swift’s Grammy’s Speech Was Negative and Immature

There are two things I know for sure. First, Taylor Swift is humorless. And second, Kanye West is a bloated bag of nuts. When combined, you get a can’t-miss car crash of insults on repeat. For those that missed the back-story, Kanye West inserted a song lyric that said he made “that bitch famous” in reference to Taylor Swift, and insisted that Swift blessed the barb before its release and “found it funny.” Swift countered that she found it misogynistic and objected to the idea that Kanye’s infamous on-stage take-down at the MTV Video Music Awards was responsible for her subsequent super-stardom. I need not state the obvious fact that Swift was already hugely successful. When Swift received the Grammy for Album of the Year last night, she used that moment to take a dig at Kanye West and disguised it in an uplifting bow, saying, “As the first woman to win album of the year at the Grammys twice, I want to say to all the young women out there: there are going to be people along the way who will try to undercut your success or take credit for your accomplishments or your fame. But if you just focus on the work and you don’t let those people sidetrack you, someday when you get where you’re going, you’ll look around and you’ll know it was you and the people who love you who put you there and that will be the greatest feeling in the world.”

The media is making this out to be some beautiful soliloquy of sweetness, rather than what it actually is. A DIG. Why waste even a millisecond of your great moment taking a hit at West, who doesn’t deserve a breath of your time? If the purpose was really to empower women, as she suggested, she could have clearly accomplished that without the negative zing. This is akin to a yoga-loving person that meditates with motivational quotes on her wall while insisting she’s super happy, only to cry each night in the corner of her room. (Too deep?).

I think Taylor Swift is great, and I have two of her albums. I like her. I like her style, and I’ve heard through numerous insiders that she treats everyone in her circle with the greatest respect. I’ve heard she’s kind, professional, and classy. But I’d encourage her to shrug insults off her back a little more often, especially when it comes from heavy-hitters. It just adds darkness to the light she’s trying to emanate, and it sends a bad message.

Lady Gaga Announces Mattel Monster High Doll

Who better to collaborate with Mattel’s Monster High dolls than Lady Gaga, who has a loyal base of “Little Monster” followers? On the heels of her much buzzed about Super Bowl performance and her upcoming tribute to David Bowie at the Grammy Awards, the star teamed up with costume designer sister to design a doll in her likeness, which will be available this Fall. All proceeds will benefit the Born This Way Foundation.

Rachel Weisz Interviews With The Violet Files

The very beautiful Academy Award winning actress Rachel Weisz visited New York’s Transit Museum for a subway-themed shoot with The Violet Files and photographer Ben Hassett. She has two critically-acclaimed films debuting this season, ‘Youth’ and ‘The Lobster’ and she answered a few interesting questions. Read quotes from the interview below.

On self-doubt: “I like that feeling of being scared, of thinking, ‘I don’t know if I can do this, it’s too hard, it’s too complicated, it’s too unknowable.’”

On acting in university: “I was a bit shy, really, and terrible at auditioning… in fact, there was a moment when I thought I would do some kind of Ph.D.”

On finding her stride: “It took me a long time to get to that place where you park all self-consciousness and judgment at the door. You have to be willing to make a real arse out of yourself.”

On women she admires: “I admire Catherine Deneuve’s hair in the Polanski film Repulsion, and I love everything she wears. But I so don’t look like her; she’s so far away from me.”

On her favorite thing about the subway: “There are often guys who drum on, like, plastic cans – it transforms the ride. I’ve got a real thing for drummers.”

The Headstrong Project Words of War Fundraiser

The Headstrong Project held its 3rd Annual Words of War fundraiser to benefit the organization, and the night began with a moving video tribute for Sgt. Gary Johnston by Gerardo “Tony” Mena, followed by a performance of Bryan Doerries’ “Theater of War” from Emmy Award Winner John Turturro & Academy Award Nominee Amy Ryan. Late Night host Seth Meyers also led a panel discussion with Veterans, followed by a live auction. Event proceeds will be directed to effective, cost-free mental healthcare to post-9/11 combat veterans suffering from post-traumatic stress.
